O’FALLON CITY COUNCIL
MEETING MINUTES
July 6, 2009

The meeting was called to order at 7:05 p.m. by Mayor Gary Graham who then asked a visiting Boy Scout Troop to come forward and lead the Council in “The Pledge of Allegiance to the Flag.”  

Philip Goodwin, City Clerk, called the roll:  Nila Grogan, present; Gene McCoskey, present; Ed True, present; Dan Polites, present; Rick Reckamp, present; Jerry Mouser, excused; John Drolet, present; Allen Medford, excused; Michael Bennett, present; Dennis Renner, present; Steve Engler, present; Ned Drolet, excused; Jerry Albrecht, excused.  A quorum was declared present.

Motion by R. Reckamp and seconded by E. True to approve the minutes of
June 15, 2009.  All ayes.  Motion carried.  

PUBLIC HEARING – No hearing scheduled.

RESIDENTS:  Stewart Drolet spoke regarding his concern with the Family Sports Park and about the tournaments bringing people to hotels.  He stated that the hotels appeared to be full, and if the City had any data on occupancy.  Mayor Graham replied that he believed that they had below 70% occupancy throughout the year.  Mayor Graham said that the Parks intent was to set our City apart from the other cities in the area.  The first priority is the children in the community.  We had 472,000 people through our parks last year.  People want greenspace and parks.  He added that the average age of O’Fallon residents is 35.  

REPORTS:

Clerk’s Report:  City Clerk Goodwin read the following requests:

1.  Request from St. Nicholas Church to conduct a raffle for a weekly cash drawing from September 2009 – June 2010.

  • Request from CertaPro Painters to conduct a raffle for a $10,000 paint job on July 18, 2009.  This is in conjunction with the Lipstick Women’s Show.
Motion by R. Reckamp and seconded by D. Polites to approve the raffle request from St. Nicholas Church.  All ayes. Motion carried.

After discussion on the paint job raffle, Mayor Graham stated that they would need to post a bond or financial statement.

Motion by D. Renner and seconded by M. Bennett to approve the raffle request from CertoPro Painters to include posting a bond.  All ayes. Motion carried.

Mayor’s Report:    Mayor Graham introduced Miss O’Fallon 2008, Gabriela Windey.  She thanked the community for the experience.  She enjoyed the ribbon cuttings and ground breakings.  She had a fantastic year and loved working with the children – especially the “Make a Wish” Foundation.  She also thanked O’Fallon for the donation of scholarship money.  She plans to attend the University of Colorado.  Mayor Graham thanked her for being such a great role model.

Mayor Graham asked the O’Fallon Baseball team to come forward as he read a proclamation declaring July 7th as O’Fallon Township High School Panther Baseball Team Day and introduced the team.  Mayor Graham said he is really proud of them as it is a lifetime event.  Coach Jason Portz said one of the players could not be here because he was playing for the Minnesota Twins.  Coach Joe Bowers was also in attendance.  Coach Portz thanked the Parks system and the City for their support.

Mayor Graham read a proclamation declaring the month of July as Recreation and Parks Month.  He presented the proclamation to Mary Jeanne Hutchison, Director of Parks and Recreation.  He thanked her and the staff for the great programs they provide.

Mayor Graham announced the appointment of Deor Jorgensen and the re-appointment of Jodi Caticchhio to the Arts Commission.

Motion by M. Bennett and seconded by E. True to approve the appointments.  All ayes.  Motion carried.

Mayor Graham announced that Tom Faulkner had resigned as alderman for Ward 7 for personal reasons and asked for approval for David Cozad as the replacement alderman for Ward 7.

Motion by G. McCoskey and seconded by N. Grogan to approve the appointment of David Cozad as Ward 7 alderman.

City Clerk Goodwin swore D. Cozad in to office as the alderman for Ward 7.

RESOLUTIONS:  

Motion by D. Renner and seconded by E. True to consider Resolution Items 1 – 7 under the Omnibus Agreement.  All ayes.  Motion carried.  

Mayor Graham read the following resolutions:

ITEM 1 – Resolution Approving the Release of Executive Session Minutes

ITEM 2 - Resolution Recommending Schedule B of the Executive Session Minutes Remain Closed because the need for Confidentiality Still Exists

ITEM 3 – Resolution Authorizing the Mayor to Execute an Agreement with LW Contractors, Inc. for the Wesley Drive Culvert Improvements in an amount not to exceed $353,117.72

ITEM 4 - Resolution Authorizing the Mayor to Execute an Agreement with Burns & McDonnell for the Design of the Water Main Extension from the Intersection of Illinois Rte. 159 and Milburn School Road to the Intersection of Northshore and Dunhill in Fairview Heights in an amount not to exceed $69,400

ITEM 5 – Resolution Authorizing the purchase of Real Estate referred to as Parcel #1, 03-26.0-412-014

ITEM 6 - Resolution Authorizing the Acceptance of the Gift of Real Estate from the Weinel Development Company, Parcel #2, 04-30.0-105-022

ITEM 7 – Resolution Approving and Accepting a Plat to be known as the Eagle Drive Right-of-Way (ROW) Dedication and Easement Plat

Motion by D. Renner and seconded by N. Grogan to approve Resolution Items 1 – 7 under the previous Omnibus Agreement.

ROLL CALL:  Grogan, aye; McCoskey, aye; True, aye; Polites, aye; R. Reckamp, aye; Drolet, J., aye; Bennett, aye; Renner, aye; Engler, aye; Cozad, aye.  All Ayes.  Motion carried.

Motion by R. Reckamp and seconded by G. McCoskey to approve Resolution Item 8 – A resolution authorizing the Mayor to execute an agreement with Planning Design Studio, LLC for a contract for Family Sports Park Phase 3 Bidding and construction documents in the amount not to exceed $700,000.

J. Drolet said that he had concerns about the agreement on page 4 and 5 in that the language stated that the fee would be in a “lump sum” fee of $700,000.  She answered that it will be 7% of the contract and will be invoiced in stages as work is completed.

Mayor Graham said that Dale would look at it, but agreed that it should not be one lump sum.

Mayor Graham stated that there would be a free swim night at the Community Pool on July 20th.

ORDINANCES:

1st Readings -  No first readings listed.

2nd Readings –  

Motion by D. Renner and seconded by E. True to consider Ordinances #9 - #12 under the Omnibus Agreement.  All ayes.  Motion carried.

Motion by D. Renner and seconded by E. True to approve Ordinances #9 - #12 under the previous Omnibus Agreement.

Mayor Graham read the following ordinances:

9.  Ord. Deleting in its Entirety Chapter 51, Section 51.125, 51.126, 51.127, and 51.128, Regarding Pierons – Prairie Lawns Sanitary Sewer District

10.  Ord. amending Chapter 77, Schedule III, Stop Signs, Regarding Keck Ridge

11.  Ord. Authorizing the City of O'Fallon to Borrow Funds from the Water Pollution Control Loan Program

12.  Ord. Amending Ord. 623, Zoning, Simons Auto Repair Parking Lot Expansion

STANDING COMMITTEES:

Community Development:  Motion by D. Renner and seconded by D. Polites to approve a Special Event request from New Life in Christ Church for the “C2G: The Invitation” for Saturday, July 11th and Sunday, July 12th from 9 – 6:00 p.m. at the public park.

ROLL CALL:  Grogan, aye; McCoskey, aye; True, aye; Polites, aye; R. Reckamp, aye; Drolet, J., aye; Bennett, aye; Renner, no; Engler, aye; Cozad, aye.  Ayes -9; Nays - 1.  Motion carried.

Public Works:  D. Polites stated that the committee will meet on the 4th Monday at 7:00 p.m.

Public Safety:  No report.

Finance/Administration:   Motion by M. Bennett and seconded by R. Reckamp to approve Warrant #187 in the amount of $1,068,660.90.

M. Bennett stated that the next scheduled meeting is July 27th at 5:30 p.m.

In addition, he commented that in this past month, we had six new businesses open.  Mayor Graham added that Wal-Mart spent one million dollar in renovations.  O’Fallon is one of their top markets.

R. Reckamp added that out of the six businesses, four were owned by women and two by minorities.  We are a diverse community.

Parks and Environment:  D. Renner stated that the committee meeting is next Monday at 5:30 p.m.

EXECUTIVE SESSION:  None scheduled.

Motion by R. Reckamp and seconded by D. Renner to adjourn.  All ayes.  Motion carried.
