City Council Minutes 9/21/2009

O’FALLON CITY COUNCIL
MEETING MINUTES
September 21, 2009

The meeting was called to order at 7:02 p.m. by Mayor Gary Graham who led the Council in “The Pledge of Allegiance to the Flag.”  

Philip Goodwin, City Clerk, called the roll:  Nila Grogan, present; Gene McCoskey, present; Ed True, present; Dan Polites, present; Rick Reckamp, present; Jerry Mouser, present; John~Drolet, present; Allen Medford, present; Michael Bennett, present; Dennis Renner, present; Steve Engler, present; Ned Drolet, present; Jerry Albrecht, present; David Cozad, present.  A quorum was declared present.

Motion by J. Mouser and seconded by N. Grogan to approve the minutes of
September 8, 2009, as amended.  R. Reckamp noted that the roll call count on page 5 should have read “9” ayes and “3” nays.  N. Drolet requested that City Treasurer, Dave Hursey’s notes be attached to the minutes.  All ayes.  Motion carried.  

PUBLIC HEARING – None scheduled.

RESIDENTS:    No one came forward.

Mayor Graham introduced Olivia Pribbanow as Mayor of the Day.

REPORTS:

Clerk’s Report:  City Clerk Goodwin read a request from the VFW Post 805 to conduct a Veteran’s parade on November 11, 2009 from 2:00 p.m. – 3:30 p.m.

Motion by R. Reckamp and seconded by E. True to approve the requests.  All ayes.  Motion carried.

City Clerk Goodwin read a request from O’Fallon/Fairview Heights Lions Club to conduct a roadblock on Friday, October 9 from 7:00 a.m. – 10:30 a.m. and 2:30 p.m. – 5:30 p.m. and Saturday, October 10 from 7:00 a.m. – 10:30 a.m.  Note:  This would be against the no two consecutive weekends rule as outlined in Section 111.08 (2) of the Code of Ordinances.

Motion by D. Renner and seconded by J. Mouser to approve the request.

N. Drolet stated that this is against the ordinance stating that there will be no roadblocks in three consecutive weekends.

Motion by N. Drolet and seconded by A. Medford to amend the motion to change their dates to either November 6 & 7 or November 13 and 14.  

E. True was concerned that we could not legally change their dates for them.  He also wanted to know why they needed that weekend.  City Clerk Goodwin said that they are having a statewide fundraiser.

J. Drolet stated they asked for ten hours, but the ordinance is restricted to eight hours.

J. Betten answered that there is a limitation of the number of hours on Friday and Saturday.

D. Renner mentioned that the Lion’s Club does a lot of good work with the eyeglass program in O’Fallon.  He can’t say enough about them.

Mayor Graham stated that during the roadblock last weekend, many people used the back streets in order to avoid them.  The people are just trying to get to work.  On the vote, a yes means you are going to deny their request for the dates.

J. Drolet voiced his concern because we had already approved a roadblock in November.  N. Drolet said that O.U.S.A.R.T has the weekend of November 27th and 28th.

Vote on the date change:

Motion by R. Reckamp and seconded by M. Bennett to amend the motion to limit their hours from ten to eight according to the ordinance.

N. Drolet said that we should not set a precedent by ignoring the ordinance.  R. Reckamp agreed.  M. Bennett said that he did not think it would set a precedent by not following the ordinance for this event.

Vote on original motion:

ROLL CALL:  Grogan, aye; McCoskey, no; True; no; Polites, aye; Reckamp, no; Mouser, aye; Drolet, J., no; Medford, no; Bennett, aye; Renner, aye; Engler, no; Drolet, N., no; Albrecht, yes; Cozad, aye.  Ayes - 7; Nays – 7.   Mayor Graham broke the tie by voting no.  Motion failed.

Mayor’s Report:    

Mayor Graham asked for a moment of silence for a famous resident, Bernie Fuchs, who passed away Thursday night.  He was born in O’Fallon and lived off of Third Street.  He graduated from O’Fallon Township High School.  Bernie was in the same class as Norman Rockwell.   His wife’s father was the mayor in 1950.  He won more than 100 awards.  He kept his roots here.  The Historical Museum has a corner set aside for his works.  There will be a Memorial Service for him in Washington on Wednesday, and the Mayor is going to have the flags fly at half mast in his honor.

1st Readings –

Motion by N. Drolet and seconded by S. Engler to consider on 1st Reading Item 1 – An Ordinance An Ord. Amending Chapter 96, Alarm Systems, Sections 96.01, 96.02, 96.03 regarding Fire Alarms, Connection to 911, and Service Alarms.

2nd Readings –  

Motion by N. Drolet and seconded by R. Reckamp to approve on 2nd Reading An Ordinance Amending Chapter 72.10, Stopping, Standing or Parking prohibited regarding the Ferncliffe Court Stub.

D. Polites spoke to one of the neighbors on the corner who requested that they place an additional sign up that prevents the stopping or picking up of children in that area.

Mayor Graham asked for clarification of the ordinance wording.  J. Betten clarified that the ordinance does include the stopping and dropping off of children.  He will look into it further.

STANDING COMMITTEES

Community Development:  J. Mouser stated they met on September 14th, and a copy of the minutes was included in the packet.  

Motion by J. Mouser and seconded by D. Renner to approve the Special Event requests 1, 2, 3, 5 and 6 as listed under the Omnibus Agreement.   All ayes.  Motion carried.

Motion by J. Mouser and seconded by D. Renner to approve the Special Event requests listed and he read them aloud.

Special Event request from the First Baptist Church of O’Fallon Gives Back to hold their event on September 26th from 11:00 a.m. – 1:00 p.m.

Special Event request from the First Baptist Church to hold the 7th Annual Men’s Wild Game Night on October 1st from 5:30 p.m. – 9:00 p.m.

Special Event request from the New Enterprise Academy to hold their 4th Annual 5k Run/Walk on October 24th from 8:00 a.m. – 10:30 a.m.

Special Event request from Cambridge House for the Fall Fun Fair to be held on October 10th from 1:00 p.m. – 4:00 p.m.

         Special Event request from the Rotary Club of O’Fallon Sunrise for the
           Pork with Passion to be held on October 3rd from 9:00 a.m. – 11:00 a.m.

Motion by J. Mouser and seconded by M. Bennett to approve the Special Event request from Dragonfly Secrets for an Outdoor Seating and Banner from approval to December 1, 2009.

D. Renner stated that the sidewalks are narrow, and he is concerned that the sidewalk could be blocked when the car bumpers may hang over the curb.  J. Mouser said that Jennifer mentioned that a walking path of 4 – 6 feet is fine.  

Mayor Graham said that the points are well taken, but we have struggled in the downtown area.  We need to support the businesses.  Traffic does not seem to be a problem on the sidewalks.

J. Mouser said that Lebanon has a thriving downtown.  They have tables and chairs set out on the sidewalk.  D. Renner said they do not park diagonally in Lebanon.

Public Works:  A. Medford made a motion seconded by J. Albrecht to approve awarding the copper water line bid to HD Supply Waterworks in the amount of $22,775.

A. Medford that the next meeting will be held Monday, September 28th at 7:00 p.m. in the Mayor’s Conference room.

Public Safety:  N. Drolet stated that the minutes from the last meeting were in the packet and the next meeting is October 12th at 7:00 p.m.  

D. Renner mentioned that he has concerns with the bicyclists riding three or four abreast on Milburn School Road.  J. Betten answered that you just have to proceed cautiously.  They do get complaints frequently.  It is a violation to create an obstruction to the traffic flow.

Finance/Administration:   Motion by M. Bennett and seconded by J. Albrecht to approve Warrant #192 in two parts, the first one being Gifts for Individuals in the amount of $489.83.

Motion by D. Renner and seconded by N. Grogan to adjourn.  All ayes.  Motion carried.
